Trade policy overview

General regulation

Since August 25, 2009 export and import of substances destroying ozone is to be permitted in the following cases: using them as raw materials for producing other chemical substances; in the special cases of other application and in the exceptions stipulated by the Montreal protocol; for transit transportation across Russia from the states being members of the Montreal protocol to the similar states (Russian Government resolution №678, August 20, 2009)

Non-tariff measures

The amendments are made in the Russian tariff heading numbers in respect of light crude oil lifted in the specific deposits of East Siberia. For this purpose individual tariff heading number 2709 00 900 1 is given to this kind of oil since September 21, 2009. (Russian Government resolution №574, July 16, 2009)
The amendments are also made in the Russian tariff heading numbers in respect of heavy distillates since November 18, 2009. In particular, individual tariff heading numbers are given to heating fuel oil and other heavy distillates (2710 19 510 1, 2710 19 510 9, 2710 19 550 1, 2710 19 550 9, 2710 19 610 1, 2710 19 610 9, 2710 19 630 1, 2710 19 630 9, 2710 19 650 1, 2710 19 650 9, 2710 19 690 1 and 2710 19 690 9) (Russian Government resolution №728, September 14, 2009). Since January 6, 2010, the amendments are also made in the Russian tariff heading numbers in respect of light distillates. Tariff heading number 2710 11 900 0 (other light distillates) is excluded. Tariff heading number 2710 11 900 1 is given to propylene trimers and tetramers and 2710 11 900 9 – for other light distillates. (Russian Government resolution №876, October 31, 2009)

Tariff measures

The rate of export customs duty on crude oil and raw oil products (2709) produced of bituminous rocks and exported from the RF territory outside the borders of the Customs Union member states was set at USD222 per a ton since August 1, 2009, USD238.6 per a ton from September 1, 2009, USD240.7 per a ton from October 1, 2009, USD231.2 per a ton from November 1, 2009 and USD271 per a ton from December 1, 2009. Export customs duty rate on light crude oil lifted in 13 deposits of East Siberia (2709 00 900 1) is set at 0% of customs value since December 1, 2009. The rate of export customs duty on the main light oil products and liquefied oil gases (tariff heading numbers 2710 11 – 2710 19 490, 2711 12 – 2711 19 000 0, 2902 20 000 0 – 2902 43 000 0) was set at USD161.9 per a ton since August 1, 2009, USD173.1 per a ton since September 1, 2009, USD174.5 per a ton since October 1, 2009, USD168.1 per a ton since November 1, 2009 and USD194.9 per a ton since December 1, 2009.
The rate on the dark oil products (tariff heading numbers 2710 19 510 0 – 2710 99 000 0, 2712 and 2713) was set at USD87.2 per a ton since August 1, 2009, USD93.2 since September 1, 2009, USD94 per a ton since October 1, 2009, USD90.5 per a ton since November 1, 2009 and USD105 per a ton since December 1, 2009. Since October 8, 2009 export customs duty is imposed on magnesium waste and scrap (8104 20 000 0) at the rate 20% of customs value, but not less than EUR138 per a ton. Prior to it, export customs duty on these goods had been absent. (Russian Government resolution №771, October 2, 2009)

Import regulation

Non-tariff measures

The list of tobacco products subject to obligatory conformity certification for selling or using in the Russian territory is fixed since December 26, 2009. The list includes cigars, cigarillos, cigarettes etc. (2402 10 000 0 and 2420), smoking tobacco (2403 10 100 0), chewing and snuffing tobacco (2403 99 100 0) and other tobacco (2403 99 900 9). Russia’s Government passed a list fishing equipment banned for import. Since September 5, 2009, they include: ready made fish-nets made of nylon and other polyamide threads (5608 11 190 0); ready made fish-nets made of other synthetic threads (5608 11 990 0); electrical devices for catching fish (8543 20 000 0). Since September 10, 2009, the ban has been imposed on registering the following goods for the customs regime of free customs zone applied in Kaliningrad region: building bricks and other ceramic wares for construction (6904 10 000 0 and 6904 90 000 0); cans for conserving foodstuffs (7310 21 110 0); metal covers for closing cans with foodstuffs (from 8309 90 900 0). Tariff and tax measures

The RF Government set temporary import customs duties on plates, ribbons, films and stripes made of complex polyether (3921 90 190 0) at the rate 10% of customs value, but not less than EUR0.35 евроper kg for 9 months since July 23, 2009. Prior to it, the constant rate on theses goods had been 10% of customs value. (Russian Government resolution №499, June 15, 2009)
The temporary import customs duty at the rate of 5% customs value, but not less than EUR0.7 per kg is set on pentaerythrite (2905 42 000 0) for the period of 9 months since July 23, 2009. Prior to it, the constant rate on this chemical had been 5% of customs value. (Russian Government resolution №500, June 15, 2009). The RF Government turned zero temporary import customs rates on the certain chemicals for tanning (3201 10 000 0, 3201 20 000, 3201 90 200 0, 3202 10 000 0, 3204 12 000 0, 3809 93 000 0, 4001 21 000 0 and 4005 99 000 0) into constant ones since June 26, 2009. Prior to September 26, 2008 the constant rates on the goods had been 5% of customs value. (Russian Government resolution №533, June 25, 2009)
The temporary import customs duty on tropical timber sheets for covering furniture not thicker than 1 mm (4408 39 310 0) at the rate of 0% of customs value has also become a constant one since July 25, 2009. Prior to October 24, 2008 the constant rate on the goods had been 10% of customs value. (Russian Government resolution №537, June 26, 2009)
Since August 14, 2009, the temporary import customs duty on car bodies (8707 10 900 0) at the rate 15% of customs value, but not less than EUR5000 per a unit has also become a constant one. Prior to November 14, 2008 the constant rate on the goods had been 15% of customs value. (Russian Government resolution №616, July 30, 2009)
The RF Government set temporary import customs duties on dryers (8421 12 000 0) at the rate 10% of customs value, and on equipment for laundries (8450 20 000 0, 8451 10 000 0, 8451 21 900 0, 8451 29 000 0, 8451 30 300 0 and 8451 30 800 0) at the rate 5% of customs value since September 4, 2009 for the period of 9 months. Prior to it, the constant rates on these goods had been 5% and 0% of customs value, accordingly. (Russian Government resolution №617, July 30, 2009).
The RF Government extended temporary import customs duty rates on plasma modules (screens) and liquid crystal devices (8529 90 870 1, 8529 90 870 2 and 9013 80 200 0) for the period of 9 months since August 19, 2009. The temporary rates on modules (8529 90 870 1 and 8529 90 870 2) and liquid crystal devices (9013 80 200 0) are 0% of customs value; the temporary rates on modules (8529 90 870 9) are 10% of customs value. Prior to November 19, 2008 had been 10% of customs value. (Russian Government resolution №664, August 19, 2009)
Since September 21, 2009 the temporary import customs duties on the certain spare parts, devices and equipment for aircrafts and on aviation training devices (4011 30 000 0, 7007 21 800 1, 7320 20 810 2, 7320 20 850 2, 7320 20 890 2, 7320 90 900 2, 8108 90 600 2, 8302 42 000 1, 8405 10 000 1, 8411 81 000 1, 8411 91 000 2, 8411 99 009 1, 8412 21 200 8, 8412 21 800 3, 8412 29 200 1, 8412 29 890 1, 8412 31 000 1, 8412 39 000 1, 8412 90 400 2, 8415 83 000 1, 8479 89 970 1, 8507 30 200 1, 8528 49 100 1, 8528 49 210 1, 8528 59 100 1, 8528 59 900 1, 8531 90 850 2, 8536 20 100 2, 8536 20 900 2, 8542 32 100 1, 8803 30 000 0, 8805 29 000 1, 8907 10 000 0, 9014 20 200 1, 9014 20 800 1, 9401 10 000 and 9401 90 100 0) at the rate 0% of customs value have become constant ones. The Russian Government made amendments in the RF Customs Tariff in respect of the certain kinds of cheeses. Tariff heading numbers of cheeses are simplified, and the single rate 15% of customs value, but not less than EUR0.5 per kg is set on cheese (0406 90) since September 25, 2009. Prior to it, the import customs duty rates had been EUR0.3-0.7 per kg. (Russian Government resolution №680, August 20, 2009)

Antidumping duty is imposed since September 25, 2009 for the period of 4 years on synthetic nylon threads (5402 19 000 0, 5402 45 000 0, 5402 51 000 0 and 5402 61 000 0) originated from Ukraine. The antidumping duty rate is 11.6% of customs value. The ordinary import customs duty rate is 10% of customs value. (Russian Government resolution №681, August 20, 2009)
The temporary zero import customs duty rates on the certain goods for medicine (8419 39 100 1, 8421 21 000 1, 8474 39 100 1, 8474 80 101 0, 9006 30 000 0, 9018 32 100 0, 9018 39 000 0, 9018 41 000 0, 9018 50 100 0, 9018 50 900 0, 9022 30 000 0 and 9022 90 100 0) have become constant ones since August 21, 2009. Prior to November 21, 2008 the constant rates on the goods had been 5% of customs value. (Russian Government resolution №696, August 21, 2009)
Since August 28, 2009, the temporary import customs duty on ceramic wares used for producing automobile catalysts neutralizing gases (6909 19 000 1) at the rate 0% of customs value has become a constant one. Prior to November 28, 2008 the constant rate on the goods had been 5% of customs value. (Russian Government resolution №700, August 28, 2009)
The RF Government extended temporary import customs duties on the certain kinds of metal cutting equipment for producing kitchen metal wares (8455 22 000 5, 8460 31 000 1 and 8460 90 900 5) for 9 months since September 8, 2009 г at the rate 0% of customs value. Prior to December 8, 2008 the constant rates on the goods had been 5-10% of customs value. (Russian Government resolution №719, September 8, 2009)

The temporary import customs duty on vehicles for driving on snow (8703 10 110 0) has been set at the rate 10% of customs value for the period of 9 months since October 18, 2009. Prior to it, the constant rate on the vehicles had been 5% of customs value. (Russian Government resolution №727, September 14, 2009)
Since October 18, 2009 for the period of 9 months the temporary import customs duty has been set on other PVC not mixed with other components (3904 10 009 9) at the rate 15% of customs value, but not less than EUR0.12 per kg. Prior to it, the constant rate on the chemical had been 15% of customs value. (Russian Government resolution №729, September 14, 2009)
The RF Government set temporary import customs duty on caustic soda (2815 11 000 0) at the rate 15% of customs value, but not less than EUR0.07 per kg since October 18, 2009 for the period of 9 months. Prior to it> the constant rate had been 15% of customs value. (Russian Government resolution №730, September 14, 2009)
Tariff heading numbers of the civil airplanes have changed and temporary import duty rates have been set on these planes since October 18, 2009 for the period of 9 months. In particular, the temporary rates at 0% of customs value are set on planes having not more than 50 passenger seats (8802 30 000 2 and 8802 40 001 1). The same temporary import customs duty rates are set on planes having more than 300 passenger seats (8802 40 002 3), passenger planes with empty weight more than 120 t (8802 40 009 1) and cargo planes with maximum full weight more than 370 t and without own lifting equipment (8802 40 009 3). The other civil planes (8802 30 000 8, 8802 40 001 2, 8802 40 001 9, 8802 40 002, 8802 40 002 2, 8802 40 002 9, 8802 40 009 2 and 8802 40 009 9) are to be levied with temporary import customs duties at the rate 20% of customs value.

Prior to October 18, 2009 the rates at 0% of customs value had been set on civil planes with empty weight 2-15 t and with not more than 50 passenger seats (8802 30 000 1), civil planes with empty weight not more than 20 t and with not more than 19 passenger seats (8802 40 000 4) and civil planes having not more than 300 passenger seats (8802 40 000 5). The other civil planes had been levied with the rate 20% of customs value. (Russian Government resolution №738, September 15, 2009)

The RF Government set temporary import customs duties on the certain kinds of equipment and their parts at the rate 5% of customs value since October 22, 2009 for the period of 9 months. Prior to October 22, 2009, the constant rates on these goods had been 0% of customs value. (Russian Government resolution №742, September 15, 2009)
The Russian Government passed a resolution on measures for protecting Russian producers of stainless steel pipes and tubes. According to the resolution, the special duty at the rate 28.1% of customs value is set on import of stainless steel pipes with external diameter not more than 426 mm (7304 11 100 1, 7304 11 100 2, 7304 11 100 9, 7304 11 300 1, 7304 11 300 2, 7304 11 300 9, 7304 11 900 1, 7304 11 900 2, 7304 11 900 9, 7304 41 000 9, 7304 49 100 0, 7304 49 920 0, 7304 49 990 0, 7306 11 110 0, 7306 11 190 0, 7306 11 900 0, 7306 40 200 1, 7305 40 200 9 and 7306 40 800 9). The ordinary import customs duty rates on the pipes are 5-15% of customs value.

The resolution has come into effect since November 2, 2009 for the period of 3 years. The special duty is not applied on import of the pipes originated from Belarus and the developing countries, except Brazil, and China, including Taiwan, Hong Kong and Macao. Since November 2, 2009, the constant import customs duties have been set once again on the certain stainless steel pipes (7304 41 000 9, 7304 49 100 0, 7304 49 920 0 и7306 11 900 0) at the rate 15% of customs value, as it had been before February 14, 2009. These pipes were levied with temporary import customs duty rates 20% of customs value from February 14, 2009 until November 2, 2009. (Russian Government resolution №759, September 28, 2009)

The RF Government set a temporary import customs duty on the certain types of ventilation equipment (8414 60 000 0) at the rate 10% of customs value since November 2, 2009 for the period of 9 months. Prior to it, the constant rate on the equipment had been 0% of customs value. (Russian Government resolution №760, September 28, 2009)
The amendments have been made in the RF Customs Tariff in respect of automatic pressing lines. Since December 13, 2009, pressing lines with automatic loading of steel sheets and automatic unloading of body parts of vehicles (8462 10 100 1) are levied with the import customs duty rate 0% of customs value. The other automatic pressing lines (8462 10 100 9) are levied with the rate 10% of customs value, as before. (Russian Government resolution №803, October 5, 2009)
The Russian Government extended the validity period of its resolution №903 of December 5, 2008 for 9 months since October 12, 2009 until July 12, 2010. The RF Government kept increased temporary import customs duty rates imposed on automobiles imported by legal entities since January 12, 2009 (see our journal #4 of 2009, p.37). The validity period of resolution № 813 of November 7, 2008 is extended for 9 months since October 14, 2009. In particular, the temporary rate at 0% of customs value is extended on ferrous metals waste and scrap (7204 10 000 0, 7204 21 100 0, 7204 21 900 0, 7204 29 000 0, 7204 30 000 0, 7204 41 100 0, 7204 41 910 0, 7204 41 990 0, 7204 49 100 0, 7204 49 300 0, 7204 49 900 0 and 7204 50 000 0), as well as on the certain kinds of rolled steel (7208 51 910 0, 7210 49 000 1 and 7225 40 300 9). Prior to January 14, 2009, the constant rate on the goods had been 5% of customs value. (Russian Government resolution №809, October 14, 2009)

The RF Government set a temporary import customs duty on drops for contact lenses (3307 90 000 2) at the rate 5% of customs value for the period of 9 months since January 6, 2010. Prior to it, the constant rate on the goods had been 15% of customs value. The other toilet and cosmetic items (3307 90 000 8) will be levied with the temporary rate 15% of customs value, as before. (Russian Government resolution №874, October 31, 2009)

Since November 21, 2009 import of technology lines for producing cement with capacity 5000 tons of clinker a day (8474 20 900 0) has been exempted from payment of VAT. (Russian Government resolution №890, November 5, 2009)
The RF Government extended validity period of temporary import customs duty rates on the certain kinds of wagons for high speed electric trains (8603 10 000 1 and 8605 00 000 1) since November 14, 2009 for 9 months. The temporary rate on the wagons is 0% of customs value compared to 5-10% of customs value before February 14, 2009. The other wagons (8603 10 000 9 and 8605 00 000 9) are levied with the rates 5% and 10% of customs value, as it had been before February 14, 2009. The RF Government set temporary import customs duties on rubber, chemically specified (4001 22 000 0) and other rubber (4001 29 000 0) at the rate 0% of customs value for the period of 9 months since December 20, 2009. Prior to it, the constant rate on the goods had been 5% of customs value. (Russian Government resolution №932, November 16, 2009)
Temporary import customs duty rates are established on completing parts for producing glasses since January 20, 2010 for the period of 9 months. The rate 15% of customs value is imposed on the plastic completing parts (9003 90 000 1), and the rate 0% of customs value – on the other completing parts (9003 90 000 9). Prior to January 20, 2010, the constant rate on the goods had been 15% of customs value. (Russian Government resolution №933, November 16, 2009)

The RF Government extended the validity period of temporary import customs duty rates on the certain kinds of combines (8433 51 000 1, 8433 51 000 9, 8433 59 110 1 and 8433 59 110 9) for 9 months since November 14, 2009. The temporary rate on the combines is 15% of customs value, but not less than EUR120 per 1 kilowatt of capacity of their engines. Prior to July 26, 2007, the constant rate on the second hand combines had been EUR70 per 1 kilowatt of capacity of their engines/ and on the new combines – 5% of customs value, but not less than EUR100 per 1 kilowatt of capacity of their engines. (Russian Government resolution №940, November 14, 2009). Since December 27, 2009 for the period of 9 months the temporary import customs duties have been set on stainless knives at the rate 15% of customs value, but not less than EUR1.6 per a kg (8211 91 300 0) and on the certain kitchen and table stainless wares (8215 20 100 0 and 8215 99 100 0) at the rate 20% of customs value, but not less than EUR1.6 per kg. Prior to December 27, 2009, the constant rates on the goods had been 15% and 20% of customs value, accordingly. (Russian Government resolution №942, November 23, 2009)
The RF Government made a decision to set a special duty on stainless steel kitchen and table wares (8211 91 300 0, 8215 20 100 0 and 8215 99 100 0) at the rate USD1.4 per kg since December 27, 2009 for the period of 3 years. The special duty is not to be applied on the goods originated from Belarus and the developing countries enjoying the Russian national preferential system, except China, including Taiwan, Hong Kong and Macao. Prior to December 27, 2009 the constant rates on the goods had been 15-20% of customs value. (Russian Government resolution №943, November 23, 2009).
